Geen beoordeling geldigheid van oudere modellen in nietigheidsprocedure

Gemeenschapsmodellenrecht. Nietigheidsprocedure op grond van artikel 25 lid 1 sub b jo. artikel 4 en 6 lid 1 GModVo (nietigheid wegens gebrek aan eigen karakter).

De Nietigheidsafdeling besliste eerder dat het Gemeenschapsmodel met inschrijvingsnummer 001734401-0001 nietig was op grond van artikel 25 lid 1 sub b jo. artikel 4 en artikel 6 lid 1 GModVo (een gebrek aan eigen karakter). De Nietigheidsafdeling was van mening dat het model geen andere algemene indruk wekte bij de geïnformeerde gebruiker dan de door de verzoeker ingeroepen oudere modellen. De modelhouder stelde daarop hoger beroep in. [dit beroep faalt en er volgt een obiter dictum over de geldigheid van ingeroepen oudere modellen].

In de beroepsprocedure erkent de modelhouder dat er overeenkomsten bestaan tussen haar eigen model en de door de verzoeker aangevoerde oudere modellen. Deze overeenkomsten zouden echter het gevolg zijn van de beperkte vrijheid van de ontwerper, hetgeen volgens de modelhouder zou blijken uit het overeenstemmende uiterlijk van twee oudere telefoons. De Kamer van Beroep gaat hier niet in mee en oordeelt dat er voldoende alternatieve vormgevingsopties mogelijk zijn. In het licht van deze niet-beperkte vrijheid van de ontwerper bestaan er tussen het oudere model en de modelregistratie onvoldoende verschillen om een andere algemene indruk bij de geïnformeerde gebruiker te wekken.

De Kamer van Beroep stelt voorts: "In any case, the Board recalls that the contested RCD has to be compared with the prior designs invoked by the invalidity applicant and not with other models of mobile phones."

De overweging van de Kamer van Beroep is volgens mij obiter dictum en bedoeld om eventuele onduidelijkheid te voorkomen. Een nietigheidsprocedure biedt immers geen ruimte voor de beoordeling van de geldigheid van de door de verzoeker ingeroepen oudere modellen, hiervoor kan de modelhouder eventueel zelf een nietigheidsprocedure starten.

20 The Invalidity Division identified and analysed the common features and the differences between the designs. These findings are not contested by the parties. The design holder’s main argument relates to the alleged limited freedom of the designer in the field of mobile telephones (in particular ‘bar phones’) which it tries to illustrate by reference to some images of two other models of mobile phones: LG GU-280 and Sony Ericsson K770.
21 The Board notes that, before the Invalidity Division, the design holder referred to these two models and filed images showing the control keypads, lower parts and profiles of these telephones. However, in the Board’s view, such selective images cannot serve as a point of reference. None of these images shows the telephone as a whole so it is not possible to assess their similarities and differences with the designs at issue. In addition, on the basis of the evidence filed, it is not possible to ascertain the disclosure date of the designs referred to by the design holder.
22 In any case, the Board recalls that the contested RCD has to be compared with the prior designs invoked by the invalidity applicant and not with other models of mobile phones. The Invalidity Division carried out a detailed and thorough comparison which is hereby endorsed by the Board.
23 Contrary to the arguments adduced by the design holder, the Invalidity Division’s finding as to the degree of freedom of the designer is fully backed by the evidence filed by the invalidity applicant showing the variety of designs on the market of mobile phones, including bar phones. Although the shape of a mobile phone is in general similar and the buttons are below the screen, the cut of the edges, the shape of the numeric keys can take various forms (square, rectangular, circular) and combinations (with or without spaces between the keys).
